In an editorial in the Washington Post, Richard Goldstone claimed that he is now aware of information that would have produced “a different document” than the extremely critical report he had issued to the UN in 2009.

In stating his regrets about the report, Goldstone explained that the “fact-finding mission did not have such evidence explaining the circumstances in which we said civilians in Gaza were targeted, because it probably would have influenced our findings about intentionality and war crimes.”

Goldstone also said that in light of a recent Israeli investigation he had reconsidered the facts concerning the IDF shelling of the al-Simouni family home that killed some 29 people. He now believes the incident to be consequence of “an Israeli commander’s erroneous interpretation of a drone image” rather than an intentional targeting of civilians.

In the article, he continued to claim that “Israel’s lack of cooperation with our investigation meant that we were not able to corroborate how many Gazans killed were civilians and how many were combatants.”

The judge ended his editorial by claiming that his teams’ original report “has led to numerous ‘lessons learned’ and policy changes,” while restating that, “regrettably, there has been no effort by Hamas in Gaza to investigate the allegations of its war crimes and possible crimes against humanity.
